PROCESSING PURPOSES AND LEGAL BASES<\/span><\/p>

1. Contractual obligations<\/span><\/p>

When contacting us for the purpose of entering into a contract, we process your data to take actions requested by you before concluding the contract, such as negotiations or presenting an offer (based on Article 6(1)(b) of the GDPR). The data will be processed for the period necessary to fulfill your request. If no contract is concluded within this period, the data will be deleted. However, if a contract is concluded, the data will continue to be processed until the contract is executed and any claims arising from the contract are time-barred, based on the legitimate interest of the Administrator, which includes defense and claims enforcement (Article 6(1)(b) and (f) of the GDPR).\u00a0<\/p>

a) Contract execution (e.g., communication related to its performance, payment confirmation) based on Article 6(1)(b) of the GDPR;\u00a0<\/p>

b) Fulfillment of legal obligations incumbent on the Administrator, including tax obligations, issuance of VAT invoices, handling complaints, and fulfilling the duty of information (based on Article 6(1)\u00a9 of the GDPR);\u00a0<\/p>

c) Archival (evidence) purposes to secure information in case of legal need for proving facts, for eventual determination, investigation, or defense against claims, based on the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), which includes claims enforcement and document archiving.\u00a0<\/p>

The scope of personal data necessary for contract conclusion depends on its subject matter. However, the Administrator always requests only the data essential for contract conclusion. Providing this data is mandatory for contract conclusion.<\/p>

2. Traditional and Email Correspondence\u00a0<\/span><\/p>

In the case of correspondence directed to the Administrator via email or traditional mail, which is not related to service provision or the execution of another contract, the personal data contained therein are processed to handle requests or inquiries submitted in the correspondence.\u00a0<\/p>

The legal basis for processing in such cases is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), which involves conducting correspondence and handling requests and inquiries related to business activities. Providing personal data is voluntary, but necessary for handling the request.<\/p>

In the case of telephone contact, when matters are not related to service provision on your behalf or the execution of another contract, the personal data provided by you are processed to handle requests or inquiries submitted during the call.<\/p>

The legal basis for processing in such cases is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), which involves handling requests and inquiries related to business activities. The Administrator may request the necessary data to process your request, and providing such data is mandatory for handling the request.<\/p>

4. Contact with Contractors\u2019 or Clients\u2019 Employees<\/span><\/p>

If you contact us by phone or email in connection with a contract concluded with your employer or actions taken at their request before concluding a contract, the data obtained in this way are processed to execute the concluded contract and perform actions at their request before the contract is concluded (based on Article 6(1)(b) of the GDPR). Additionally, the data are processed for the purpose of claims enforcement and defense, which constitutes the legitimate interest of the Administrator in protecting their rights (based on Article 6(1)(f) of the GDPR).<\/p>

If you contact us for a different reason than a concluded contract, we process your data to answer your questions or resolve the matter you are addressing. The legal basis for processing is the legitimate interest of the Administrator in providing answers to your questions or resolving matters related to their business activities (based on Article 6(1)(f) of the GDPR).<\/p>

5. Other Legal Bases for Processing<\/span><\/p>

Your data may also be processed to fulfill legally binding obligations on the Data Controller (based on Article 6(1)\u00a9 of the GDPR), including tax obligations, obligations arising from the Civil Code, GDPR, issuing VAT invoices, handling complaints, and fulfilling the duty of information.<\/p>

DATA RECIPIENTS<\/span><\/p>

1. Data Processing Subcontractors and Data Sharing\u00a0<\/span><\/p>

We may share your personal data with entities we use for processing, such as accounting firms, legal firms, IT companies, document destruction services, document archiving services, courier and transportation services, and providers of email access. The Administrator will also share your data when necessary due to legal obligations.<\/p>

DATA RETENTION PERIOD<\/span><\/p>

The duration for which we can process your personal data depends on the legal basis that constitutes a legitimate reason for processing data by the Administrator. We will never process personal data beyond the period specified by the legal bases. Accordingly, we inform you that:<\/p>

3. If the Administrator processes personal data necessary for contract execution, the processing period lasts until the possibility of pursuing claims related to the contract ceases for either party.<\/p>

4. If the Administrator processes personal data based on legitimate interests, the processing period lasts until the cessation of those interests (e.g., the statute of limitations for civil claims) or until the person whose data is processed objects to further processing\u2014when such objection is legally permissible.<\/p>

5. If the Administrator processes personal data due to legal obligations, the processing periods are determined by those legal provisions.<\/p>
